Effective date: 06/07/2025
We’re so stoked you’re considering joining a Swell Society retreat! Before booking, please take a moment to read through the terms and conditions below. These are in place to protect both you and us, and to ensure a smooth and safe experience for everyone involved.

These Terms and Conditions (“Terms”) govern the participation in surf retreats and other services offered by PT Swell Society Surf ("we", "our", "us") to participants ("you", "participant", or "guest"). By booking and attending our retreat, you agree to be bound by these Terms.

  • You must be at least 18 years of age to participate.
  • You must have the physical and mental capacity to participate in physically demanding activities such as surfing.

  • A deposit of $499 USD is required upon booking to secure your spot.
  • Full payment is due no later than 30 days prior to the retreat start date.
  • Payments must be made via our authorised booking platform or by bank transfer to our designated Indonesian account.
  • Payments are non-refundable unless stated in our Cancellation Policy.
  • Payment plans are available, but all installment payments must be completed no later than 30 days before the retreat start date. No extensions are granted beyond this deadline.
  • Late payments may result in the automatic cancellation of your booking without notice, and without a refund. We are not obligated to hold your spot if the final balance is unpaid after the due date.

  • Cancellations made at least 7 months before the retreat start date are eligible for a full refund or a credit that can be applied to a future retreat.
  • Cancellations made 3 to 6 months before the retreat start date: the deposit is non- refundable, but any remaining balance paid can be refunded or credited.
  • Cancellations made within 3 months of the retreat start date are non-refundable.
  • All refunds are subject to a 10% administrative fee and may exclude any non-refundable costs (e.g., accommodation, third-party bookings).
  • We reserve the right to cancel or reschedule retreats due to force majeure events (e.g., natural disasters, government regulations, weather and surf conditions, or if minimum participant requirements are not met). In such cases, a full refund or credit will be offered.
  • You may transfer your booking to a future retreat of equal value up to 60 days before the original retreat start date. Transfers are subject to availability and must be for a retreat of the same duration and cost. Any price differences must be paid by the participant.

Failure to Attend / Early Departure
  • If you fail to attend, arrive late, or choose to leave the retreat early for any reason, no refunds or credits will be issued. This includes but is not limited to personal emergencies, dissatisfaction, or scheduling conflicts.
Medical Exceptions
  • If you are unable to participate due to a medical condition, a valid medical certificate from a licensed healthcare provider must be submitted no later than 7 days after the retreat start date in order for any credit request to be considered. If granted, such credits may be applied to a future retreat within 12 months and are strictly non-transferable to another person. Please note that medical credit considerations apply solely to the participant named in the booking and do not extend to family members or other accompanying people.

  • You are responsible for your own travel insurance, including coverage for personal injury, medical emergencies, trip cancellation, and surfing-related activities.
  • You must be in a good physical condition and able to swim confidently.
  • You are required to disclose any medical conditions or medications.
  • You must comply with all instructions and safety protocols given by our staff.
  • You warrant that you are 18 years or older at the time of booking and participation.

All participants are required to obtain comprehensive travel insurance that covers:
  • Trip cancellation or changes
  • Medical emergencies
  • Lost or stolen belongings
  • Surf-related injuries and evacuation
  • Use of scooters/mopeds
PT Swell Society Surf takes no responsibility for any costs incurred due to personal loss, injury, travel delays, or medical emergencies. By booking your spot, you agree to secure appropriate travel insurance and acknowledge that this responsibility lies solely with you.

By submitting your booking, you acknowledge and voluntarily accept that surfing, ocean activities, outdoor adventures, travel, and physical movement involve inherent and unpredictable risks which may result in personal injury, illness, permanent disability , property damage, or death. You confirm that you fully understand these risks and choose to participate entirely at your own risk.

By participating in the retreat and signing these Terms and Conditions you expressly agree to
the following:
  • You assume full responsibility for any and all risks, injuries, damages or losses, whether known or unknown, arising from your participation.
  • You irrevocably release, discharge, and hold harmless PT Swell Society Surf, its directors, employees, agents, facilitators, and partners from any and all liability, claims, demands, or causes of action, to the fullest extent permitted by law, for any injury, loss, damage, or expense you may suffer in connection with your participation in the retreat.
  • This release applies regardless of whether the injury or loss results from negligence (except in cases of proven willful misconduct or gross negligence as defined under Indonesian law), force majeure, accidents or any other cause.
  • You agree to indemnify and hold PT Swell Society Surf harmless against any claims or liabilities brought by third parties as a result of your actions during the retreat.

  • All content, photos, videos, and materials on our website or produced during retreats remain the sole intellectual property of PT Swell Society Surf. Participants grant us a royalty-free license to use photos or videos taken during retreats for promotional use, unless a written opt-out is submitted prior to the event.
  • If you do not wish to appear in promotional photos or videos, you must notify us in writing before the retreat starts.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia. Any dispute arising shall be resolved in the jurisdiction of Denpasar District Court (Pengadilan Negeri Denpasar).

We may update these Terms at any time. Continued use of our services implies acceptance of the revised Terms.
